Silly question: Step parents getting money from Bio parents
Forums:
I know this is an off the wall question and I already know the answer going to ask anyway. My DH never asked the BM for child support for the 3 teenage boys. I have financially raised them for the last 2 years. Is there anyway I can take her to court for not contributing to them? like school clothes, materials, etc. I doubt you can but it's an interesting question.
Did you keep receipts? Where
Did you keep receipts? Where are you from? Are you in a shared account with your husband?
You cannot. But he can, and
You cannot. But he can, and should.
Nope. Only your H can go
Nope. Only your H can go after her for arrears, and that is only if there is a CO outlining that she was to pay support.
Otherwise, I'm sorry to say, kiss that money goodbye unless your H is going to reimburse you for those expenses.
We live in texas and she is
We live in texas and she is in Arizona. We do have a bills account which we pay all the bills, groceries and whatever the kids need out of that. We don't keep receipts. He won't go after her for CS is there a way to make a man do that lol
Well then. You're pretty much
Well then. You're pretty much screwed.
You did however build up nice karma for taking care of your SS's. At least they have you looking after their best interests. Because it sounds like neither your H or his ex are as interested in their well being.
Your H is a jackass for not going after CS.
Well my DH feels like if he
Well my DH feels like if he can support them without her help then he is fine without CS. Yeah we don't need the money to support them but if she would help then they would get more then what we give them. Plus, the oldest is about to start driving so we have cars and college to support. Ughhh! He hates dealing with lawyers as well b/c they are so expensive and it doesn't help that she is in another state.
No but DH can nail her ass to
No but DH can nail her ass to the wall for CS and can ask for an retroactive inforcement date. Until then there is nothign you as a Sparent can do.
I researched suing the Sperm Idiot and Sperm Clan for the delta between half of the ~$285K that the DOA says it takes to raise a kid from birth to age 18 and the ~40K that DickHead paid in CS. Sadly my attorney said it would be great fun to do it but we would lose. So, we just focused on barring their idiot asses instead.
That is fun though.
It will cost you about $5,000
It will cost you about $5,000 to hire an attorney to get child support. Will it pay off in the long run? If not, it's probably not worth it to your husband.
However, pretty much every state has an interest in making sure all children have the financial support of TWO parents. It would be easy, and most states and counties also have the forms available and legal self-help available online to file yourself without an attorney. If this REALLY matters to you, you can start doing some research, find out what you need to do, fill out the forms, and ask your husband to please sign and file. Then, stay on top of what he needs to do with the court afterwards. No attorneys, and just a filing fee. It's a lot of work and there are a lot of things that you can do wrong. I'm a law student with a lot of knowledge about family law, and I'm still petrified of screwing up my fiancé's docs because he has a very litigious BM to deal with. But, doing it yourself is an option. Good luck.
If you go for child support,
If you go for child support, she'll get time with them. Lots of parents don't get court orders because they don't want mandated time spent with the non-involved parent. I've paid THOUSANDS over the years, just an investment.
