FDH just got laid off...question
Forums:
:O
It was a very good paying job, but unfortunately the company cares more about it's finances than it's employees.
He has 50% custody...is he still going to have to pay the regular CS while he's not working?
This just happened and we haven't had a chance to talk yet, and I obviously don't know much about any of this crap.
It probably depends on where
It probably depends on where you live and the guidelines there. Where I live, my husband would be able to file to have it immediately reduced based on his new income (assuming he would start collecting unemployment insurance).
Did you mean that they could
Did you mean that they could "impute" his income? My husband has also been told by his lawyer that this is what they would do if he willfully quit his high paying job and chose to make far less money doing something he was over-qualified for.
Oh thank God. I was hoping
Oh thank God. I was hoping this was the case and that I was misunderstanding something. How can you afford xxxx in child support when you're now only bringing in 0 or just xx ??
No, it definitely won't be
No, it definitely won't be imputed when he's been laid off. It's only when someone voluntarily decreases their income.
I sure hope it works that way
I sure hope it works that way here! Thanks for the info.
Thanks Tommar. How are you?
Thanks Tommar.

Yay! Good to hear
Yay! Good to hear
I've heard something about
I've heard something about them taking your 'income potential', but what if you're unable to find a job where you can actually make that 'potential'??
I think he had to collect unemployment before, and I think there is some kind of cap on that.
We're in PA.
Thanks for your comments!
Don't be so sure about that.
Don't be so sure about that. When DH left Medusa, they were running a very successful business together. She changed the locks and wouldn't let him back on the premises. The (prior) Judge didn't give two shits and told DH to "get a job and support your kids."
When I first met DH, I didn't believe this, so I read the transcript. It was true....
I hope OP's husband gets a break on his CS while he looks for a new job!!
No, they won't do that if
No, they won't do that if he's been laid off. That only happens when someone chooses to earn less than they have been.
Thank you!! I'm not sure the
Thank you!!
I'm not sure the market for his job field is that great around here, so that's scary.
Yes! WTH?? I sure hope things change someday with this 50/50 CS bullshit!
Thank you, I'm sure he start
Thank you, I'm sure he start doing whatever he needs to do right away. I'm just scared because I don't really know how all of this works.
Thank you all for your
