Alimony Anyone?
We have no problem paying CS and sometimes more if the kids need something. However the alimony is just ridiculous. Our lawyer is currently working on getting it dropped since all of the children are in school and she is working now. We had a system outside of the custody agreement because she said she needed time to date. We have had them 50/50 for about 3 months. BM agreed to drop the alimony if we continued to pay full child support. When BMs boyfriend dropped her now BM says go back to the original custody agreement and pay her the alimony again. We'll of course we are taking her to court now. We've been told most judges will not grant 50/50 custody because it's disruptive to the children. However we do live in the same town and in the same school district. BM has moved four times in less than a year and can not make it on the 24,000 dollars a year we pay her... I don't think we will get 50/50 custody but I am hoping this almimony gets dropped. Experience or stories would be helpful for me not go insane lol
Did you get anything in
Did you get anything in writting or any proof that she had agreed to it before she broke up with her BF?
Out lawyer has told us that
Out lawyer has told us that the terms they used interim and permanent spousal support means two things. Interim meaning during divorce proceedings and up to 6 months after the divorce is final. Permanent meaning until she is remarried, files an income tax, all the children are in school allowing her time to work or up to two years. She's trying to find a loophole since two of those things are true. We are expecting to have to pay it for awhile but we would like a light at the end of the tunnel. When the children are with her they are consistently tardy and absent for school. Yesterday she says her car wouldn't start and they were late... She lives across the street from the school. Their grades improved when they started staying with us half of the time and it's all documented. They have never been absent or tardy when we have had them. We had a notarized paper with the notaries number instead of a seal. Well dumb us thought it wasn't legal and told her to fix it... She never returned it to us.. Then we find out that the paper has no legal standing anyways. Agh
I think once she is served
I think once she is served with papers she will change her tune. She is terrified of lawyers and going to court. I hope she caves and just settles out of court.
Our attorney is doing some
Our attorney is doing some research to see what the best step is for dropping it. Time will tell
What are the terms of the
What are the terms of the alimony ? In our state, it's typically 3 years with a marriage over 10 years or it's the old-fashioned til remarriage or death.
We have had a few different
We have had a few different answers on that one which is why we wanted the attorney to look into it... Is there a resource I can look for that information online?
I figure that it will be
I figure that it will be about two years at the most maybe even less. Our attorney was very surprised that he signed the papers with the paragraph being as vague as it is on the alimony. Since it was a consented divorce and not a considered divorce where the judge decides it will be a little easier to modify because the judge won't be changing his own decision. DH had a meeting with one of the kids teachers today and let them know he exists and their education is important to them. I was shocked to eat them say that them being absent and tardy so frequently was not really noticed by them. He has meetings with the other twos teachers tomorrow. We do want them to know who we are but also it will piss BM off to no end. Which is a bonus. The statement from their joint account we deposit her CS and alimony comes to my house and she has no financial skills. In one day she spent over 100 dollars on fast food. It truly amazes me at the amount of times they eat out in one day. What was even crazier is that at the times she was spending all this money the kids were in school.
