child support arrears legal question.

Both my kids are adults their child support was to end when each graduated high school or when they turn 18. I'm assuming it ended for ex at that time as he never paid.

I did go through the PA to get something. They finally caught up with him and today was his court date. Now I didn't go for a # of reasons, I was wondering though did that hurt me or what.

Or does anyone know how that works? He owes about 40k. Thanks

I guess I am not sure how that would work. First off, you going or not shouldn't have anything to do with it. My DH got hauled in for a CS review when BM was off over halfway cross the country on a month long vacation!

I don't understand how he got to quit paying support if he has so much arrears. My son's "father" is still $12K+ in arrears. After my son's current support was over, the amount decreased but he was (until recently) still making the lower payments towards the arrears. My DS is 23.

I never got a letter from court, I found out through ex sister. But he got away with it b/c he job hops. Then for some reason when he custody of his other kids they refused to collect told me he had to take care of them. Eye roll here.

He did pay every once in a while but that was it. I was mainly wondering if they would use the fact that I wasn't there to get out of it.

CS arrears don't just go away. It is my understanding that in a bankruptcy situation that a CP that is owed CS becomes an unsecured creditor.

I would call an attorney for a free consultation to find out where you likely stand and what the likely outcome will be.
