Just got back from court!!
I wish you could see my happy dance!!
Things went better than I could have asked for. I was not found in contempt. Judge even kinda laughed that he was even asking for it. Ding Dong was even caught telling a few lies on the stand. He first tried to say he did not have to give 30 days notice. My attorney made him read our degree on the stand and he got caught. Then he tried to say that we had been having verbal conversations for months about his vacation and that I was all for him having those days right up until it came time to start vacation. He also tried to say he never sent me a letter asking for his times. Wrong, and my attorney again had him read his letter out loud - caught again.
So the judge told him there was no way to hold me in contempt when he can't follow the rules. I did nothing wrong and he did nothing right.
As far as unblocking the girl's phone line goes the judge said there is no reason to do so. He can not follow our rules and there is another phone to call so we do not have to unblock Ding Dong's number.
His CS did go down a very small amount ($10) and was not stopped the way he wanted. He has not received his final amount from his workman's comp settlement as of yet. It is estimated that it will be around 50-75K. So our daughters should receive a good chunk of that. It will go into a college fund for later use. He is suppose to be released to go back to work the first part of March and the final settlement amount should be in soon so we will be back in court again real soon.
Ding Dong tried to make some statements on the stand about my hubby. Ding Dong does not like him at all and at one point even physically assaulted him. The judge pointed out to him that hubby is apparently a good SF and Ding Dong had best appreciate that fact and move on with life. Oh how I wanted to laugh out loud at that one!
So all in all it was a good day for us and a very bad day for Ding Dong. Wish I was a drinker a bottle of your favorite wine for everybody!!

Oh yes, it was!! I laughed as
Oh yes, it was!!
I laughed as we were leaving because when Ding Dong came into the courthouse he had his dad with him and they were so sugary sweet, nicey-nice, and all fake smiles. Can we say over confident? When they left they stormed out and were not nice at all. If looks could kill my support system and I would be dead now. Just made the win all the more sweeter.
Congrats!!!
Congrats!!!
Yes i get the vacation dates.
Yes i get the vacation dates. I asked first and had the proof. As far as te girls activities go we couldnt bring it up because it wasnt on the motion papers. On the other hand, we will be going back to court again soon and will make sure its brought up then. Luckily, they dont have much of anything scheduled for March.
Thank you guys for the support and helping to keep me on the right path.
My lawyer told me yesterday
My lawyer told me yesterday that he would look into writing up a clause and let me approve it before he presented it to Ding Dong's lawyer or the judge. I printed off the paper you mentioned in your blog and told him what my goal was so we'll see what he comes up with.
I figure cheerleading tryouts will be our next hurdle. If it works like it did last year they will be on his weekend. We all but bent over backwards so she could tryout. Unfortunately, she didn't make it last year, but we have high hopes for this year.
Ding Dong did come to some of her softball games last fall and he came to 1 volleyball game. If he was working I could understand why he doesn't come up for her games as he does live 1 - 1 1/2 hours away. But the man has no job and no other responsibilities right now. His girlfriend/fiance lives another 1/2 hour past our town (so he drives right through here to get to her) and he visits her all the time. Myself, I couldn't care less if he came, but our daughters look for him.
