OT- Passports for kids

My sons freshman class is offering a package for the students to go to Paris and I think this is a great opportunity for him but he will need a passport. That's where I run into a problem I have to have "sperm donars" signature. He is a dead beat dad and is not involved in his childrens life, hasn't seen them for years and the times he has called he has called from a private number. I have no clue where he is, lives or how to contact him. Everything I have researched and everyone I have talked to say I need his signature. Just wondering if anyone here has had a similar situation or any suggestions and what steps to take next.

If you have sole legal custody, you must do the following:

-Appear in person with the minor
-Sign Form DS-11 in front of an Acceptance Agent
-Submit primary evidence of sole authority to apply for the child with one of the following:
-------Minor's certified U.S. or foreign birth certificate listing only the applying parent
-------Court order granting sole custody to the applying parent (unless child's travel is restricted by that order)
-------Court order specifically permitting applying parent's or guardian's travel with the child

NOTE: If none of the above documentation is available, the applying parent must submit Form DS-3053 stating why the non-applying parent/guardian's consent cannot be obtained

My SO had to get passports for skids. BM refused to sign the paperwork. He HAD to go to court. She did not show up so the judge gave him permission to get the passports without BMs signature. He sent the letter from the judge in with the paperwork and he received the passports. It took a few months and some money but he finally got them.
