I do not believe this. I just got our file from the attorney who quit our case due to the BM's constant harrassment of him. He's an attorney, you would think he knows how to put a stop to that. But that's another story. Apparently he has been with-holding info form us. The BM has recently stated in her petition that I am abusive to the SS's, that I retain the children from school, that I lock them in closets for days on end and feed them insects and dirty toilet water!!!!! WTF????
I mean, really, even if I were doing those things, how would she know? She hasn't seen the SS's in almost a year. Aside from the fact that all of this can be proven as a lie, I am still furious that she would stoop this low. Retain them from school? Please. I WANT them to go, at least I get a few hours of peace that way. Abuse them? She had DHS at our door so much that I couldn't even if I wanted to. Feed them insects and give them dirty toilet water? Right. I have the time to go crawling around the ground, digging for those disgusting creatures, for the express purpose of punishing my SS's. And I don't even let my animals drink out of the toilet. Lock them in closets? They wouldn't fit, for one thing, there is too much of their toys and clothes in them, nevermind that the closets have no locks on them and as the boys are 8 & 9 I am almost sure they could figure out how to open the door and get out, providing I shut them in there. Oh God, take away my strength, for I may just beat her to death. What should I do, call her? No one has heard from in almost a year. Let it go? Drive up there and do to her what she is accusing me of doing to the SS's? GRRRRR, I am so ANGRY!!!

Forgive me if you've already explained this--what is the petition for? And how recently what it entered?
Without having much info., I can't comment too much but I want to say that I am very sorry to hear that you;ve been accused of such terrible and puzzling behavior. I assume that BM is trying to get the kids back? Is that why she would do this?
Child Custody Modification
The orginal petition was entered in Sept 2005. The accusations were entered this past March. No, she doesn't want the kids back, she just doesn't want me to have them. She doesn't want DH but she doesn't want me to have him. She wants to put the SS's in a boys ranch and collect CS from DH.

Like you said she has been away for almost a year now and hardly calls them anyways, seems like she isn't trying hard enuf to get them.
She's nuts, and any judge who knows that she neglected to call and keep in contact with her sons shouldn't even consider her.
May visitations. Is she even paying child support???

to some of your question. As to child support, she has NEVER paid. The judge ordered no visitations in October of 2006 due to child molestation accusations from SS8 on her.

thanks for the laugh, and i don't mean that rudely. it's just that we have been dealing with similar scenarios, except my sd doesn't live with us. if you haven't talked to her, don't ruin it now by initiating conversation. a lot of times these crazy, miserable bitches do this simply to get a rise out of us. believe me, i know how hard it is to refrain from retaliation but it's just not worth it. i mean, what would come of the conversation besides her pissing you off even more and making up additional lies? nothing. she's not worth it. just get a lawyer and have him/her shut her ass down. thank god, we finally have a judge who sees right through bm...

She's accusing you of these things, but is she actually petitioning you for anything? It's highly likely that your lawyer didn't tell you because he knew nothing would come of it and he didn't want to give you any additional stress.
Honestly, I wouldn't worry about it if I were you. She knows that you don't do anything wrong and she needs to have something to say negative about you to make herself feel better. Even if something did come of this, no one would even begin to believe her in the first place. The fact that DCS is frequently at your home only furthers my conviction that she would be laughed at if this ever made it to court. I'm sure that's what your lawyer was thinking when he decided not to bother you with this nonsense.

She's a vexatious litigant. Ignore her. Laugh your head off at her and tell her to go get a lobotomy. If nothing else it'll give you a few days respite while she tries finding out what that means
How About CPS
Did they give you a letter back to you on any of her charges that stated they were unfounded? I don't know about your state but in mine you can actually take that letter go to a Judge and have the records reviewed and her charged with filing false reports. I was told this myself by a caseworker. Is is worth it? I dont' know. I am not fond of the family court system.
The court system
is a joke for the most part. There is a letter in the file from the judge dismissing the charges and requesting her to get a psychological eval. If she takes it, she will fail and it'll be one more piece of evidence in our corner.
