BM is in for a big suprise!
BM seems to think she still holds all the cards even though the girls live with us now. She signed total custody of the girls over to DH until the end of the school year. But now both girls want to live with us. She also think she still has total control over the CS issue.
Well guess what child support enforsement says she doesn't have squat b/c we have the kids. When DH divorced BM they had joint custody in the divorce papers, with her beginning the primary custodian "at that time" it said. Child support says b/c of that we won't have to take it back to court for custody unless she choses to fight it, and as soon as her CS is gone she won't have the money.
Social Services is also on our side and said that b/c of what went on at her house before they moved in with us, that if they went back to her home that there would be an investigation into her home. But while they are with us their hands are tide. DH plans to hold this over her head if she choses to fight.
Also as far as child support goes, Georgia says North Carolina will have the choice as to weather or not my husband still has to pay her. But since the girls now reside in the state of Georgia, they are under the state of Georgia's protection and BM WILL be paying some form of CS.
On another topic:
Many of you have been my voice of support since the girls moved in and I want to thank you VERY MUCH! My ex employer called yesterday asking me if I was ready to work again. I said YES!!! Due to me still having to watch the girls, I can't go back full time "yet"!, but as soon as DH finds a local job (and I promise he is really trying) I will go back full time.
And the moment he does get that local job, believe me I WILL be disengaging from the situation! For the first few months I will take EVERY overnight trip work can offer me. That way DH can see what I've been going thru!
I also plan on putting back some money to. Maybe not incase I chose to leave DH in the future, but so that I can have things too. Also I made DH agree that once CS is started, that it will go into it's own checking account and not in with "our" money. Then bills can be paid staight out of it for the girls and the house. I won't have anything to do with it, although I'm the one that takes care of the girls needs and all the bills. It will be his job now.
I feel like a new woman now, with the though of going back to work! YEAH! I still have hopes of finding a local job too, though. Driving tour buses is not a steady job. Also I'm afraid of being gone from home to long, b/c I know once I get home the girls and DH will have distroyed everything and I'll have to put it all back together. Plus in the past the girls have proven to be little theives, stealing my things and giving them to BM.

If its on the books in NC that your H is responsible for CS it will remain there until he gets it removed. It will always show up as delinquent on CS and your income taxes will be garnished and sent to her. I would get it resolved and get it off the books. She isn't holding the cards, but the state is and they will prosecute for non support.

As of right now DH is paying the State of Georgia CS. Then the State of Georgia sends it to the State of North Carolina, who in turn sends it to BM.
At this moment BM is getting CS although the skids are with us. We have sent the papers to North Carolina to stop CS and are waiting on them to give us a court date. However the State of Georgia says although we are paying North Carolina we can still apply for CS here in Georgia. They said if it goes through here before it ends there, then we will be paying and recieving at the same time until CS is stopped in NC.
We already have the papers filled out for both states. Since the girls now reside in Georgia though, the CS will move here. BM will not be happy about that! She hates Ga and I get a laugh out of thinking about her having to come here for CS hearings. Maybe we can get justice and take her to court a few times for no reason. I'm sure she will love the hotel bills.}:-)

Yeah, you're right eventually the case will be moved to GA. It's my understanding the county or state the children live in over rides where the non-custodial parent lives. I would have her sorry ass in court everytime she turned around..LOL. You're really smart for opening a seperate account for the CS. DH should take the responsibilty for it. Definately put back some SHE MONEY! Ya never know you may need it. Not saying you're gonna leave tomorrow, but if you have to...you can! I made the mistake of not putting back some dollars and I had to stay in a situation I didn't wanna be in all because of money! Maybe everything will work out...sounds like it might get better. If you wanna try, TRY. And, if things don't work out you will have some money to move on. Just remember don't lose your identity in all this....Good luck! KC
