Husband Lost Job and CS

Hi everyone- its been quite hectic with my new 3 month old daughter and my Husband "Common Law" has lost his job.
Can anyone tell me from experience what happens to CS when your husband has been let go?
From my research- it seems its better to ask for a reduction and not eliminate the CS all together...he will be getting a severance package- but unsure of what that will look like.
We have a Greedy Money Sucking Bitch for a BM...(it seems we all have one of those LOL).

Thanks for the input- we both have children from a previous relationship- he was given a lower amount of CS for our new baby- not sure how that will look since his CS was already reduced in november when the bitch took him back.

It varies for state to state. I know in Louisiana, the CS will not be adjusted until you get a new job. The reasoning behind it is...some people will jump to a lower paying job just to get child support lowered. Talk to a lawyer.

When my DH was laid off, we did nothing, he paid it with his unemployment and savings.
Coincidentally, BM put in for a modification at that time, not knowing that DH had been laid off. It had been so long since CS had been modified, that even though DH was unemployed, CS actually went up. Not enough for the modification to go through, thank God. Oh man, was BM pissed!
It is a toss up on what will happen. They will take any unemployment and severance package into consideration and in my DH's case, even impute what they think he should be making and therefore, able to pay.
If there is any way he can keep just paying it, it may be his best bet. Check with your CS guidelines in your province (or however they do it in Canada).

Haha thats the problem its all up to the judges discretion...I am thinking of seperating from DH because his CO says that I have to give my Income Statements to his ex(DH stupidly signed it without reading the fine print)- we both have children from different relationships. I REFUSE to pay ANYTHING to that Greedy Money Sucking Bitch.

He should do what any other person with a family would do - get another job. If you do not work and you need supplemental income or other benefits, contact your local department of family and children to see what you qualify for while he is out of work. As far as a reduction is concerned, child support is generally income based in most states with both parents incomes concerned (I am responsible for 51% of the support, while my ex is responsible for 49%) and any deviation from the court mandated standards must have a good reason because any reduction unfairly shifts the responsibility to the other parent who is already providing their share of support, and risks failure of adequately providing for the child. If there is enough reason to justify the deviation, the court would grant it, but you'll need an attorney.
That may come off as sounding a bit harsh, but after having to hold down two jobs to ensure that my children were adequately provided for when EX either only gave part of the CS or none at all - I have limited sympathy. EX routinely accuses me of "trying to rape [him] for child support." If I can work my *** off to make sure that all of my children are provided for, so can he. Besides, I'm sure you knew going into a relationship and marriage with this man, that he had another child to provide for.

We both have children from a previous relationship- so Yes I knew what I was getting into at the same time so did he(you also cannot predict when a bitch will attack)...he is still employed but is in the process of being terminated...they are setting up his severance package....I have the right to call this beast a Greedy Money Sucking Bitch- she took Dh to court for an increase while I was pregnant and at the same time I was forced to provide my financial statements to her because she wanted my money to be imputed into CS calculations when in actuality Dh got CS lowered...Im sorry your EX was like that but I guess you knew what you were getting into when you had a child with him(your ex) you cannot always judge however i understand your lack of empathy- it sounds like your EX is a Greedy Money Pinching Dick.

I've heard differently, and this was from the child support office, if you have an extreme circumstance file for a modification right away otherwise you will be responsible for the court order already in place. File quickly so if you are short on making the payment you have already notified the department and they also give any parent a grace period to find employment they do work with you. As long as he didn't voluntarily quit his job.

Yep...once the severance package is settled the Bitch will be getting an e-mail...I have heard the same thing- when my EX was on Disability the Court Advisors told me that if he isnt working doesnt have an income- he doesnt have to pay...for that time...however if he does get a severance package he does still have to pay...but he might be able to get a reduction...sorry if thats confusing just tired.
