Bio mom moving out of state without kids

bio mom has filed papers requesting permission to move out of state since new husband has joined army and is now stationed in Kentucky. The court date has been moved to september 12, so, we have come to find out thru the kids that their mom and 4 other siblings are in Kentucky and they are living with their grandparents until court papers go thru granting her permission...Can she do that?? She has not notify us of any of this..and it just seems so shady of her to already assume that she will have permission from the court. And it is not something we can prove in court that she has already moved

Sure it is. Send her a certified letter, return receipt requested, restricted signature to her signature only. It will forward in the mail, and when your return receipt gets back to you, it will show the mail forward in effect and the fact she signed for it in KY.

Well, do you WANT custody? Now is the time to get it.

Be glad she left the kids at grandparents instead of moving them anyway - had she done that, it would have established a status quo, and most judges won't change the precious status quo even if it was established counter to the court order.

wow, did not know that...my husband had been wanting custody, but everything seems so agains the dad..she knows how to play the system
