I figure this is probably the case....this is about the 3rd time she has claimed she is picking him up. So far hasnt happened, and DH will be there to pick him up no matter what, even if she decides to go against her safety plan she still does not have a license. DH is trying to get ahold of the Social Worker but she never returns his calls.....its getting quite rediculous.

I just need to remember Luchay's advice.....this is just a pile of dog poo. I acknowledge it is there but it is not going to kill me so no reason to let myself get worked up. DH will address the situation as he sees fit at the appropriate time....

Oh he has had 2 hearings for emergency transfer of custody over last 6 months, judge refused to hear on emergent basis stated it was DFS problem. Well 1 month to the day later SS ends up in our care under a safety plan she had to sign because SS got hit during a domestic dispute. She is to provide her own place to live for her and SS in order for the safety plan to be "modified".

Shortly after she was found by DFS to be guilty of failure to protect. he has been in our sole care for 2 months under the safety plan. Problem with that is at this point safety plan is voluntary by BM she can decide to enforce her custodial rights leagally at any time, however if she were to do that it could mean that SS ends up being removed officailly through the courts which puts his modification case on hold. So we dont want that to happen! DH does have a final custody hearing set for late July and I am pretty confident he will end up with custody of SS. In the beginning it was a crap shoot, but BM is just taking a nose dive as far as her life situation goes!
