I only have a minute but I am about to bust out of my skin!

We found out BM does have a job! She posted about it on facebook, been there for 4 months (at least) - medical marijuana shop across the boarder in OK. One of her ex friends is sick of her shit and reached out to DH with a mountain of screen shots. All kinds of stuff about the hearing (GAL said we aren't allowed to post anything on social media), crap talking me, crap talking DH, just all kinds of stuff. 

I am so excited about the job though!!!! I already called the social security office to find out how to report fraud. Just waiting for the lawyer to call us back. I think that we will have to wait to report it until right before the hearing. I also called a private investigator to price what it would be to get pictures of her at work. Since we know where and when she works it only like $400 to have all that done. Should be good for court. I am sure judges love a good defrauding of the government!! 

After last week we needed a win... even if nothing more happens than we get her kicked from social security, it will be a win. Social security said that she will have to repay all the benefits and there is a possibility of fines and prison depending on how much $$ we are talking about.

Just because she is working doesn't mean she will be kicked from SSI.  You can work and remain on SSI.  One of my dad's caregivers does.. there is just a limit to how much she can make over a certain period of time.

But it is set up that someone getting SSI can earn money and get back to being self sufficent.

The social media stuff.. may get a slap on the wrist.. but it probably won't make any huge difference in outcome.

So not trying to rain on your parade right now, but yeah they can still work even if they are on SSI. I have a friend who is on it for Lupus and she works part time and it's completely within the law to do so.

I hate saying it, but we were up against a raging drug addict who was in and out of jail and we still had to battle in court every 3-6 months just to keep proving DH was the better parent to retain custody. Courts love keeping the kids with the mom, no matter how bad she is.

I really do hope for you and DH that at some point you feel that the courts hear you and give you some sort of "win", I just don't think it's going to be to the extent you are hoping.

Agreed-she can still work but has to earn less then a certain amount- SSI doesn't pay didly squat anyways...the woman needs a way to support herself in SOME fashion I would think.

As to the 'courts keep kids with moms' I honestly don't think it's that- I think they see it as whomever keeps paying to go to court/keeps paying fees/keeps the fights rolling/attorneys on speed dial helps fund the court system-so they keep it rolling as long as someone is willing to pay- regardless of how the kids do/parents do

I think the rules re: working are different based on if she's SSDI or SSI.  

SSDI won't continue benefits if you hit the substantial gainful activity threshold - which is something like $1,200 these days.  That said, though, there's exemptions to that on top of the nearly year "trial run" that would potentially start the three year clock (and the 5 year expedited reinstatement clock).

SSI is where they'll reduce dollar for dollar.  Or I suppose more accurately $0.50 for dollar when you cross the (lower) threshold.

I might have the two mixed up.  Either way, someone receiving benefits is supposed to report all of the fun stuff that could impact their benefits and eligibility.  No idea if failure to report (if everything is on the up and up) actually causes one any grief or if it's just a procedural slap on the wrist.

I don't know that I would go spending money on a PI for it.  Suspected fraud can/should be reported but I wouldn't go to the length of building a fraud case for the government.  If any of it is relevant to CS orders and you collect the evidence by all means share that with the appropriate parties but I wouldn't extend myself beyond that. 

To provide "evidence" of purported fraud without the appropriate entity taking up the case or delivering a charge and verdict could backfire in family court.  And based on what you guys have experienced I would think that highly likely.

It doesn't seem the new information is any kind of game changer for your case, it just confirms what you already know - that the woman embodies all of the worst qualities of human beings.

I do hope that you guys find a way to a resolution in your hearts and your minds, even if it is not the one you hope for.  It cannot be healthy for any of you to live with the constant stress and heartache.  I know you guys have not resolved to drop the rope so I hope for nothing but good news for you guys in your next hearing.   : )

She is on disability and she is working under the table. Hopefully if/when we send in the report, she will get held accountable.

I think we are going to hire an investigator to make sure we have it all properly documented for court. If nothing else it will put an end to her hand out ofr more CS... I hope!!

Sooo from my understanding (Work in public housing software, lots of low-income/disabled, or just users of the system, etc.) If it's disability, it depnds on what the disability is to what the threshold is. They CAN work for extra income, as long as they stay below a certain amount of hours. As long as they stay below the hours, they keep their extra money.  However, all of this is required to be reported, or they risk losing benefits or having to pay benefits back, or possibly being permenantly discluded from the program.

If nothing else, this COULD reduce CS considerably.

You don't know for sure it's "under the table".   You don't know how much she is earning.. in what capacity she is employed.. whether she is submitting reports to SSI or not. 

I'm fairly certain that even if she ISN'T reporting her income to SSI.. it may well end up being under their limits and she may actually have nothing to pay back.  It is a really long time.. 9 months minimum where you have to meet that threshold.. 4 months.. worst case she will just have to start reporting now.. and if she loses the job.. whelp ... back to square one.. no benefits lost.

This is NOT anything that is worth you spending your hard earned money on.  It is likely to have ZERO impact on your custody situation/hearing.  You see a SSI cheat.. but the judge will see a "mom who is just trying to make ends meet for her children.. and just got overwhelmed by that complicated SSI system and she didn't realize she had to report her income.. oops.... but good for you BM for trying to work through your disability".

See.. how that spins?  She actually looks BETTER for trying to work!

You want to throw a wrench in her monkey?  Make a report to the SSI office and they will do an investigation and they will do what is necessary if they find she hasn't reported. 

But, leave this out of your DH's custody with the exception of if her earning extra income might reduce his obligation.. but that probably won't be the case.

I get it.. she is not a good person.  But this is the kind of thing your DH's lawyer is ignoring because they understand that it won't change anything in court.

Now now...as noted above,,,bm is TRYING to work and contribute to society in spite of her disability. How dare you Wink allude she is working the system. Bm can only work an hour or two a week. See, her tax returns she is below poverty.

SEE dh and his new wife are just awful awful people. They are just mad they have to pay child support. THEY would say and do anything to hurt me (bm) . They are trying to punish me because of childdddd suppoooorrrrrttttttttt. AND because I HAVE CUSTODY.....

YOUR HONOR--see I told youuuuu snifff snifff sniffffff,,,snort. lol

I know it's sad.. but it is not at all unusual for a BM to get that kind of spin treatment from the court.  OP and her DH have already been steamrolled in court re this lady.. I expect the beatings to continue..
