Question about child support.

constantly_irritated's picture

If BM gets full custody, and we have had it for the past 14 years, do we pay her a flat rate in child support? One of DH's friends is advising him that he would have to pay CS AND any other extra expenses like clothes, school lunches, etc., that we've paid for his whole life. I'm sure many of you have been through this and we are just starting out on the custody battle road.

Did something drastic happen? Chances are a judge wouldn't flip custody unless there was a major change with the CP.

Even if there were and she did get custody, the extras are typically agreed upon, most standard custody agreements are cs and medical but that could just be in my state

Depending on your state and CO.
Our states CS is 25 percent of BOTH parents income. BM pays 25%, DH pays 25% only the difference AFTER insurance is taken out changes hands to the lesser earning party.

Clothes
school lunches
field trips
coats
boots
prom dresses

thats all listed in the CO, if "shared expenses" is not agreed on and listed as something the parties are willing to split, then its not billable to the other party

Thanks all. I thought it was all of the above, but it was weird that someone told DH that he would not only have to pay for CS, but clothes, haircuts, entertainment, etc. I filled out the CS modification paperwork (to try to get her to pay) and there was nothing like that in those papers.

In my state, unless otherwise specified, CS is for all day to day expenses including school lunch, clothes and extracurricular activities. Medical and dental not covered by the policy is usually separate and in percentages.

We have 50/50 and hubby still has to pay child support bc she lied about how much money she makes. BM doesn't pack lunches very often for school but we do almost every day. She send money to the school up until the end of the year for lunches. If we don't pack we give the kids money for that day. At the end of the year there's usually a letter send him that one of them owes about $15 for lunches. She won't go pay and in order to get a copy of their report cards DH goes and pays the lunch fee & any library frees they have.
Extra curricular activities are not included in the CS for him. If she wants them to do something then she pays and same with DH.
Medical bills are split 50/50 excluding co pays. You take the kids you pay the co pay and 50% of the bill
