DH has primary custudy of SS2. We live in Texas. BM has yet to make any CS payments that were ordered to begin in Dec 2011. She stated to DH Friday that she was not going to pay the child support because she felt that she shouldn't have to since she gave birth to SS2, and that she would rather sign her rights away than pay CS.

Have any of you encountered this? How does the legal system work with these kinds of things? Even if she signs her right's away does she have to pay CS or the arrears?

I want her to sign them away. I know every child should know their parents but she lost custody of him because she gave him alcohol and took a picture because she thought it was kewl among other things. If she does I would then seek to legal adopt SS2.
