I've posted before about BM being high conflict and just literally psycho. She apparently has been planning some time to take my husband back to court and we've been waiting on it. We finally got the motion yesterday and well.. it's hilarious. Our lawyer said it's one of the stupidest filings he has ever read in his entire career. Here's what she put:

FATHER is in contempt because he did not follow the order concerning open communication. He will not talk and/or communicate in any other way with MOTHER in rule about the health, education and welfare of the children. (This is funny because we get them every other weekend during the school year. She does not notify him of any school grades, functions, doctor appointments, etc. and as soon as we find ringworms on the children which they have been battling for four months now he notifies her.)

While the children are at FATHERS, they must share a room with other childen because FATHER has a 3 bedroom home wherein FATHER sleeps in one room, the boys sleep in another room and all other children have to share the last room. Furthermore, FATHERS visitation should become supervised and/or while FATHER has physical custody MOTHER should be allowed to make unannounced visits to ensure that the FATHER is actually home with the minor children and that they are in good health. (This bitch is NOT setting a foot on my property whether announced or unannounced. We have 4 children.. 1 boy and 3 girls. We have a set a bunk beds with a trundle for the girls in their room. Everyone has their own bed and space.)

FATHER did not bring the children to a WIC appointment which was not in the best interest of the children and again violating the Judgement wherein he was supposed to bring the children to a pre-set appointment. Finally, because of the above reasons it is in the children's best interest that custody and visitation be modified so that MOTHER is the domiciliary parent and until the FATHER undergoes counseling and or treatment his visitation should be supervised or take place at a parenting center. (WIC has nothing to do with us and the court order says NOTHING about taking them to pre-set appointments. She is already the domiciliary parent and undergo counseling and treatment for what?!)

Finally, the children do not want to go FATHERS home and each time MOTHER tells them that its that time to go, they both cry and do not want to go. They do not feel comfortable at FATHERS home. (well, when you badger the kids after every visit and make it a negative thing.. no wonder. They do not cry not to come from what we have seen.)

Because FATHER is in contempt of court, MOTHER prays that he be cast with attorney's fees for the preparation of this rule and for all court costs for this rule for contempt. On information and belief, FATHER uses drugs an FATHER should ungo a 12 panel hair follicle drug screen. (uh.. what?)

We have mediation soon and court in January. Our lawyer was laughing and said she is stupid to try to bring this before a judge as it's oozing of parent alienation. I wrote up a two page response for our lawyer of counter claims that we actually have proof of her doing.
