If DH goes back to school, could we lower CS?

My husband recently was accepted into a 4 year degree program, with all the financing we never qualified before. Sadly a couple weeks later, he was let go from his job. He is getting a small sum from unemployment, but doesn't have any promising leads as far as getting a new job.
I plugged the numbers into my states child support calculator, and we would qualify for a QUARTER of what we pay now, which would be a big help since we are only my paycheck. A career change would make it so he would be able to provide better for us all in the future. Hubby is going to bring it up to BM shortly, but I'm certain she'll refuse the amount...

Should we have to go back to court, how do judges feel about non-custodial parents going to school full time and working part time?

They may go off his income potential, or his unemployment check.

I would go back to court and let the judge decide. If he can prove he is enrolled in school the judge may have an easier time at being more apt to lower.

Showing he is enrolled could help out......

Yes I agree. I know that when my BIL went to court to lower CS he was in school so they based it off of minimum wage....he pays just $25 a wk!

Really it is a smaller amount of CS now but when he graduates and gets a higher paying job he may pay more than he is ordered to now.

I know here in Arizona, if there is a 15% change in the income of either parent, whether 15% MORE or 15% less, that qualifies for a parent to go back to court to either reduce or increase the child support.

So I would suggest look into your state's guidelines for what qualifies for an emergency request for a decrease in child support.

Best of luck to your hubby as he works at his schooling. My hubby is s-l-o-w-l-y working on his Bachelor's via Western International University...taking online courses. It seems like it'll never end, but I know one day it will!!! Wink

Depends on where you live but if his income is reduced then yes, cs gets reduced by the courts and bm can't say boo.
