For the upcoming court case and recent mediation, BM's attorney came up with very different CS figures than DH's attorney. We are now asking for copies of her Financial Affidavit to compare to her W2. Does anyone know if/how someone can be "creative" with a Financial Affidavit. DH keeps insisting it has to match the W2 exactly and maybe he is right. I don't want us to be blind sided by us being completely upfront and then BM lying through her teeth.

The affadavit should ask what she spends money on and if she is putting in insurance or child care those things may make a difference or if she spends every last penny on basics and your DH saves, or contributes to retirement they may try to claim that as disposable income that should go to the skids. I don't know but I am sure there are ways and I am sure her attorney advised her how to go skirt reality. Smile

I know we have had problems with BM based on when we got the kids and she did... also she has a casual job so she can say her income is whatever but be working full time.

If your state is like mine, there are other factors involved in the CS calculation. Our BM's favorite way to manipulate the form is to mess with the number of days she has them. Joint custody requires a minimum of 35% of the year to each parent in visitation; and that's what she uses .. despite the fact DH is actually closer to 45%. It makes a HUGE difference in the calc.

Thanks to everyone. Its Florida state and the calculations only have net income, child care, and health insurance. So we don't really know why the financial affidavits even have to have all the expenses listed. Good idea about watching for creativity with the overnight stays, that is what she has tried in the past.
