Custody changes and therapy records

partner is filing for joint physical custody based on a myriad of issues including, but not limited to, SD not receiving timely medical care, failing in school, poor diet/nutrtion, no bedtime, no breakfast being provided before school, and inadequate supervision in the home.

SD13 has been in therapy since the divorce. while the parenting plan states that medical decisions are to be mutual, partner never had any say in the selection of this therapist. the therapist has worked exclusively with BM. BM has been allowed to sit in on sessions and obviously has worked with therapist to "guide" the sessions in terms of what should be asked/focused on.

partner has on occasion spoken to the therapist and fought to get copies of the records which he did receive. (he does have joint LEGAL custody) everything in the records is painting partner to be the bad guy, not to mention parts of the records have been redacted. when he inquired as to why things were redacted, he was told that those were statemetns made by BM. he feels entitled to that information since the sessions are technically his daughter's. therapist refuses to provide, his lawyer will be subpoenaing the records.

given the obvious bias of the therapist and the fact that partner was not consulted on the choice of therapist despite having that right via the parenting plan, do you all think the judge will not utilize the records as part of the custody hearing? What do you all think the chances are of us getting joint physical custody? ive read the courts usually prefer that. we live but 10 minutes away and the child's school, activities and friends would nto be adversely affected.

Why doesn't he take the child to his own therapist? Odds are, that the records will come into court and your boyfriend will have to refute her findings.
