Making DH take it to the judge....
Okay a couple of updates regarding the newest request for CS review (http://www.steptalk.org/node/196754) and MSD who wasn't even in school and 18 and BM was collecting CS for her. (http://www.steptalk.org/node/195632)
Regarding BM collecting CS for MSD when she wasnt living with her, 18+, a mother herself and not going to school- CS keeps saying that the only way DH can have the issue reviewed is if he files Form 60B and takes it to the courts. After much thought, we agreed its too much work and may end up costing us with court costs, etc. So we dropped that issue. I believe in karma.
Then DH gets mail last week for CS modification review. WTH. One was just done last year for the 3 year review.
So email is sent to CS and they tell us that BM requested it and she can request it since MSD was emancipated. Of course she did..... CS says they still cant do anything about the money BM collected for MSD, since she has been terminated already. We should have brought the issue to them before termination. Of course we didnt know about it until AFTER. And even though I had asked CS to look into MSD going to school, back in March. (Of course DH should have as well... he said he did, he didnt and now he got screwed- which is another reason why I didnt want to help him with the Form 60B because it was his own damn fault).
CS did say that if DH rejects the modification request it will go in front of the judge.... and then DH can bring up the issue of BM collecting money for MSD knowing she wasn't in school. CS said not sure if the judge will do anything about, but its worth a shot.
So I think that is the route that DH is going to go down.
Of course BM still isnt working full time, 25-30 hours a week. Of course since last review in October, DH got a $2/hour raise.
Has anyone had any issues with taking it to the judge? The only reason we would want to take it to the judge is for the judge to see that BM collected money when she should not have been. Plus hoping that the judge will see her as the greedy bitch that she is. Of course that is just hopeful thinking since judges seem to love to help the BMs collect as much money from their exes all while not even working full time themselves.
BM is already getting $600 a month in CS for 1 kid, how much more does she need? Does it really cost $1200 to raise a 15 year old a month?

Well BM requested the modification because MSD aged out. Just not sure if DH should "reject" it and let it go to a judge or just suck it up (as usual) and just let CS do the damn modification review.
