She responded, indirectly
Today is day number 30 since BM was served with the petition to modify custody. She did not have a formal response to the petition, but BF's lawyer was contacted today by a lawyer who is representing her. He told BF's lawyer that they are preparing her response and he should have it soon. I asked if that counted since she technically didn't legally respond in the given time frame. BF's lawyer said that even though we could legally pursue a default judgement, a judge wouldn't allow it anyway and it would only make us look bad. So even though she didn't even bother to get a lawyer until the very last possible day, we're still stuck waiting for a few more weeks for her to inevitably say no and then go into the whole process of mediation and court. And to think all of this would go away if she'd just get a job.

Ah Yes!
The good ole wait till the last minute. Our lawyer advised the same thing that we could push a default but it would make us look bad and the judge would just give her the time anyway! Crazy b/c the BM really has the power to drag this out for a very long time. We are almost to the end of our discovery period on our side which is what you will go through once the BM and lawyer responds to your petition! We are having to provide pay stubs, w'2s, phone records, insurance information, documentation we have kept etc. You may want to think about getting some of those items together in case you need them as well. Keep me posted and I will do the same for things that happend in ours. We are in same process just one step in front of you at this point.

Do any of them follow the LAWS, i'm so sick and tired of these moms getting away with everything. In Mn the new law is they are suppose to impute income,from her previous job, for my husband they will but for her they don't, it's the NEW LAW and yet nobody follows it WHY????
These women can do what they want, but really it's the system that lets them get buy with it.
