Child Support after the age of 18. WTF?!?! Really?? I would never do it! What about you??

LaMareOssa's picture

DH had to fill out all the child support papers for BM this afternoon. She will have to pay 50 bucks a month which he will never see a dime of. But, one of the options was:

"Support shall be paid after of the age of 18, adult child, until the 'child' is capable of self support and the neccessity for support ceases."

WTF?!?! Really? Using this wording is tricky, because this "adult child" could be a dependent FOREVER! Meaning, that if she/he is not working, daddy/mommy would have to pay support even if the 'adult child' was 35-40 years old!!! No fucking way!

Other options were to pay for college until graduation etc etc...

Does anyone here deal with this?!?!

too me this is STUPID "intact" families arent required to pay a dime after a kid is 18. you can kick them on the street and the world see's it as they are an adult. But when it is a poor kid of divorce all hell breaks loose.

SO's order says 18 and graduated from high school. If the kid doesn't graduate and has to do a fifth year, we would still have to pay. Unless, of course, the kid drops out... which he did.

21 here or until the graduate from college. Sd20 dropped out of college makes 12-16k. My best estimate DH is still paying support.

If the patents agree they can emancipate after high school. The burden of proof is on DH. It's STUPID.

I have no problem is SD was in school and actually dependent on her mother.

My DD19 is in college fulltime. Her dad pays HER full support. I pay her support. We pay no college bills. She needs to use what our support is and figure the rest out.

Yeah, that's what scares me. We have 1 of 3. BM has 1 who won't graduate for who knows how many years. I'm afraid once ss13 is done (he'll seriously be done before the 17 year old) she will try to get us for c/s.

I think the whole concept of child support is stupid, but that is above and beyond.

We have to until SD is 22. NJ can make you pay until 26!!!!!! It's until they graduate from college, or drop out, get married, have their own kids, etc. It can go until 26 if both of the parents also have graduate degrees. In our case both DH and BM have graduate degrees, but they got them once they were already married, so it is debatable. Luckily BM realized she can't afford to pay any more college (no matter how little she does pay) so she has told DH that it ends with SD's 4 year degree.

Since SD is away at school, CS was pro-rated for the amount of time she lives at home during breaks, which makes it about half the amount it used to be. Unfortunately DH is also required to pay 65% of her college tuition with no say on where she goes, so that really hurts. For example, she decided to go study abroad this semester and it cost 1.5 times what it had normally, and it blew his budget.

Only another year and two months...

Here it's 21 no matter what, and some people have college tuition stipulations (my DH does NOT, thank goodness).

I receive social security (death benefits)for my children, and interestingly enough I researched this, asked some questions of a senator and this is the response I received:

"In your email you inquired why Social Security child survivor benefits are usually only available up to the age of 18. Social Security auxiliary benefits were first established in 1939. In establishing child survivor benefits, Congress determined 18 to be an appropriate cut off age for these benefits."

Some of these self-righteous BM's and Skids who get to live on the dole until they're 21, 22, 24, 26, or forever don't know exactly how good they have it......
