Have you heard of "Parent Liability Child's Act?" It says parents of minor-mothers are responsible for "baby" too!

OK, the stress is really getting to me on this whole 15yr old prego...I was searching about increase/decrease, etc. in child support because of it and ran into this "Act"...which basically states that because parents are liable financially for their children, if their minor-mother child applies for TANF (welfare), etc. the state goes after the father of the minor-mother, the mother of the minor-mother, and the parent's of the minor father in order to ensure "financial support" for the baby...are you kidding me? So the baby of a minor child is more important than the BIO child of the father he had from a second marriage? Are you kidding? Has anyone had this happen to them?

I do have a friend whose son got a girl prego and basically her and her husband have ended up raising the child...they have lots of money and used a lawyer, etc...so I am assuming that when they were told they would have to financially support the kid also, they just went for custody and because of the money they have, they can afford a good lawyer to get what they want...it's been years and they still have to support this child who is close to 11...the BM has never paid them a dime in CS and it's been over 7yrs since she became 18...

I have put up with so much, but I don't think I will be able to handle it if the courts make my DH pay for this mess...of course, we don't have a pot to piss in because of BM, but in salary (before all the stuff he has to pay), he probably still makes more than all the losers that BM surrounds herself with, incl. the boy's parents...sigh...

Has anyone had this happen?

(ps. it states specifically the grandparents of the minor-mother child, ie. father's parents pay cs, but it also states that the parents of the minor-mother must pay support for their daughter, which of course worries me because it might mean an increase since they never collect CS from a custodial mother...)

My layman's opinion is that this all applies only if the minor mother seeks welfare benefits for the out-of-wedlock spawn.

So, don't let the pregnant 15yo apply for welfare benefits and this is a non issue. She can file for CS against the BioDad and his parents without seeking welfare. My assumption is that she will live with her own BioParents or at least one BioParent while the other pays some level of CS.

If for some reason this gets out of control file for forced emancipation and have the 15yo declared an emancipated minor which legally makes her an adult as far as being responsible for herself and her spawn. Criminally she may still be a minor but she would no longer be your financial problem and neither would the baby.

Once emancipation is complete you can help to whatever level you want but the DipShits in CSE and the family law courts should not be able to force you to participate financially which keeps the decisioning capability in your/DH's hands Vs in the hands of beurocrat morons.

I would be surprised if CS level paid by the pregnant minor's NCP would increase if the child who receives CS becomes pregnant.

I would love to rip a new asshole (verbally)on a bottom 10%er family law Judge who would attempt to raise CS because some idiot kids became pregnant.

In an effort to avoid just this situation our Son (SS-17) has had to repeat the following mantra every time he leaves the house with his friends for the past several years.

"No Glove, No Love!"

Oh Rags, you made me laugh with your son's mantra...haha...

Her mother is a loser...do you actually think we have any control over the daughter applying for welfare when she lives with mom and mom is a money hungry witch? We have NO control...DH for years has tried to talk to crazy kid and she just lies to him...he has no control over this mess...and because she WANTED to be preggo, she is soooo happy in her post, I doubt she'll do anything that will hurt her boyfriend...although that also means if she applies for welfare they'll go after him automatically...but believe me, mom is an expert at all this...

I'll check into that forced emancipation...I didn't find anything about that for Texas, as basically from what I read on emancipation, the state won't allow it if it means the kid will then become dependent on the government...

I will attempt to keep looking for info to protect ourselves and be informed before the due date...right now we live in a tiny house...I mean my son thinks we are "camping"...and of course need to buy a house, now with this, I don't dare move out of here until this hits the fan...I just can't stand the stress of constantly having to pay for someone else's errors...

My mom had something like this happen. My stepdad pays child support for his two kids and its about 1200 a month. Well his ex wife went on welfare and when my stepdad filed taxes that year they took his tax return to pay back the state. You would think that would be illegal right? Well it wasnt so not only did he pay her child support every month but lost his tax return because she wouldnt get a job and sat on welfare.

The key is to calculate your withholdings or quarterly estimated taxes to slightly under pay during the year so you owe a little when you file your annual tax return. This keeps anyone from taking a return that you are due.

You still end up paying the same amout of tax but you have no return so you keep the money instead of some beurocrat being able to take it from you.

You have to be careful though because you don't want to owe too much at the end of the year and put yourself in an under withholding situation.

Unfortuneately many people use their tax return as a savings account. The Gov't does not pay you interest on the money they owe you at the end of the year if you over paid your taxes. So, IMHO as tax payers we are all better off owing a bit at the end of the year and keeping our money invested as long as possible rather than giving the Gov't an interest free loan.

Again, in my humble layman's opinion of course.
